Acceptance
By using www.q-dat.com you accept these terms. If you do not accept them, please do not use the site. Paid services are governed by the signed engagement agreement, statement of work or purchase order between you and Q-DAT; where those documents conflict with these terms, they take precedence.
Use of the site
The site is provided for information and enquiry. You agree not to attempt to disrupt it, gain unauthorised access to it, extract data from it by automated means, or use it for any unlawful purpose. Information you submit through our forms must be accurate and yours to share.
Services and trial projects
Descriptions of services on this site are indicative, not an offer. A free trial project is provided to demonstrate capability on a limited sample of data, at our discretion and with no obligation on either side to proceed. Scope, volumes, turnaround times, service levels, fees and payment terms for chargeable work are set out in the engagement agreement.
Client obligations
Our output depends on the data, access and instructions you supply. You are responsible for holding the rights needed to share data with us, for the lawfulness of the processing you instruct, and for providing timely responses, credentials and clarifications. Delays or defects in the material supplied may affect agreed timelines.
Intellectual property
The Q-DAT name, logo, site content and design are our property or licensed to us, and may not be copied or reused without written permission. Data you provide remains yours. Deliverables prepared for you transfer to you on payment, except for our pre-existing methods, templates, tools and know-how, which remain ours.
Confidentiality
Each party will keep the other's confidential information in confidence, use it only for the engagement, and protect it with reasonable care. This obligation continues after the engagement ends and is reinforced by any separate non-disclosure agreement.
Disclaimers and liability
The site is provided as is, without warranty that it will be uninterrupted or error-free, and nothing on it constitutes professional advice. To the extent permitted by law, Q-DAT is not liable for indirect or consequential loss, or for loss of profit, revenue or data, arising from use of the site. Liability arising from paid services is limited as set out in the engagement agreement.
Governing law
These terms are governed by the laws of India, and the courts at Bangalore, Karnataka have exclusive jurisdiction over any dispute relating to them.
